Weingarten rights

Weingarten rights are the rights of employees to request union representation during investigatory interviews. The rights were established by the United States Supreme Court in 1975 in the case NLRB v. J. Weingarten, Inc..What are Weingarten rights?

  • Employees can request union representation during investigatory interviews
  • Employees can request a representative if they believe disciplinary action may result 
  • Discipline includes oral or written reprimands, suspension, pay reduction, demotion, or termination 
  • Employers cannot retaliate against employees for requesting a representative 

How do Weingarten rights work?

  • The union representative can advise the employee on how to answer questions 
  • The union representative can object to intimidating or confusing factors 
  • The union representative can ask the supervisor to clarify questions 
  • The union representative can request a recess to speak privately with the employee 

Who is responsible for knowing Weingarten rights? 

  • It is the employee's responsibility to know and request their Weingarten rights
  • Management is not required to inform employees of their Weingarten rights
